竊見慶曆中詔，「自今臺官毋得用見任輔臣所薦之人」。至嘉祐四年詔，「自來大臣所舉薦者不得為臺官條約除之」。兩者俱載國書。哲宗初政，中旨除范純仁、蘇轍為諫官，皆大臣呂公著、司馬光等所薦，蓋用嘉祐詔也。于是章惇曰：「故事，執政除，所薦之人見為臺諫者，皆徙他官，不可違祖宗法。」。蓋引慶曆詔也。議者謂公著、光雖賢，其事不可悉從；惇雖奸，其言不可盡棄。
